Requests and bookings

PepeMare operates as an agent and forwards the requests and bookings to the selected apartment on behalf of the traveler. Offers of accommodation are obtained free of charge for the traveler. It is intended that accommodation offers be provided exclusively to travelers who use PepeMare to find them. This includes private bookings for the traveler him or herself, his or her acquaintances or relatives and bookings by companies for their employees. Commercial resale of accommodation offers obtained from PepeMare without expressly written agreement from PepeMare is prohibited.

Accommodation contract and payment

When accommodation is arranged through PepeMare, the accommodation contract comes into effect directly between the traveler and the apartment selected by the traveler. The traveler must pay the accommodation costs quoted by PepeMare directly to the apartment. All claims and obligations arising from the accommodation contract exist directly and exclusively between the traveler and the apartment he or she selects. Once the traveler has received a booking confirmation from PepeMare, a binding booking for the selected apartment comes into effect. The booking is valid without any other written booking confirmation. Once the booking is complete, PepeMare displays the booking confirmation on the internet browser. The traveler also receives the booking confirmation by email. Due to technical uncertainties in the transfer of e-mails over the internet, PepeMare can neither check nor guarantee the arrival of the booking confirmation by email. However, this does not affect the validity of the booking.

Arrival and cancellation

In accordance with the conditions of the apartment, the traveler is obliged to arrive by the specified time. In the case of late cancellation or non-show (non-arrival), the apartment will charge the cancellation fee. In order to avoid misunderstandings, changes or cancellations of bookings arranged via PepeMare must always be made using PepeMare. It is important that the selected apartment receives the respective message from PepeMare in order that the change or cancellation can be made on time. PepeMare reserves the right to temporarily or permanently exclude internet users from its use and/or to cancel availability requests or bookings, if availability requests or bookings were repeatedly made in the past using the e-mail address given by the traveler and were not subsequently carried out.

Information on accommodation offers

PepeMare does its best to verify the accuracy of the apartment information (pictures, text, map, prices etc.) it displays. However, it is ultimately based on the information provided by the apartment, the experience of PepeMare employees or information provided by reliable third parties (e.g. travelers). As much as possible, PepeMare tries to ensure that the content of the apartment information is accurate, up-to-date and complete. However, that the content is accurate, up-to-date and complete cannot be guaranteed with complete certainty and PepeMare therefore accepts no responsibility for this.

Apartment prices

Unless otherwise expressly stated, the apartment prices given are valid per apartment, per night. The prices are shown in Euro.

Liability and warranty

All information has been compiled with the greatest care. However, no responsibility can be accepted for any errors made during data acquisition or data transfer. PepeMare therefore accepts no responsibility for ensuring that the contents made available are accurate, complete and up-to-date. Particular entries regarding prices and apartment availabilities are the sole responsibility of the apartments, in so far that PepeMare accepts no responsibility for information given by the apartment. This also applies to false information given by the apartment, which results in double-bookings. PepeMare accepts no responsibility for breaches of duty due to minor negligence, insofar as there is no effect on contractual responsibilities, life, health or body or claims in accordance with the German Law on Product Liability. PepeMare is liable for damages - irrespective of legal grounds - only in the case of intentional and gross negligence. The liability is strictly limited to the foreseeable, typical damages relating to the contract. The aforementioned limitations of liability apply accordingly to breaches of duty by PepeMare assistants. The current version of the Data Protection Directive is valid.

Miscellaneous

PepeMare reserves the right to all use and application of published contents. The replication, reproduction, distribution, electronic storage or transfer of all or part of the data to other data media or its use for any purpose other than those stated here is permitted only with the expressly written agreement of PepeMare. In the case of infringements of these General Terms and Conditions, PepeMare reserves the right to exclude travelers at any time from its further use, (cf. above). Such exclusion also includes deleting and blocking personal settings created by the traveler. PepeMare reserves the right to restrict, change or completely cease the use of PepeMare at any time and without prior notification. A legal claim by the user against the use of PepeMare is not possible. PepeMare shall inform the user of changes to these conditions of use on its website or by e-mail. If the user does not object to such changes within four weeks of notification, the changes shall be considered agreed.

Liability exclusion for links

In its decision from the 12th of May 1998, Hamburg County Court resolved that the posting of a link results in shared responsibility for the contents of the linked site, where applicable. According to Hamburg County Court, this can only be avoided if the poster of the link expressly distances him/herself from these contents. PepeMare has posted links to external websites whose contents are not influenced by PepeMare. The following therefore applies for all links: PepeMare has no influence on the configuration or contents of external websites. PepeMare therefore distances itself from the contents of all external websites, even when PepeMare posted a link to these external websites.

Applicable law / Place of jurisdiction

All legal relations between PepeMare and the user shall be subject exclusively to the law of the Federal Republic of Germany. Insofar as legally permissible, the exclusive place of jurisdiction for all disputes arising in relation to use of PepeMare is agreed to be Stuttgart. Alternatively, state law is applicable.
